NEW PHILADELPHIA – A Dover man connected to the disappearance of a 12-year-old Georgia girl has been indicted by a Tuscarawas County grand jury on six counts, including two counts of rape and one count of sexual assault.
Antonio Agustin-Ailon, 34, was also charged with one count of child custody violation and two counts of distributing sexually oriented material involving minors.

Agustin-Ailon was arrested along with the minor victim, who was reported missing in Gainesville, Georgia on May 30. They were found in a Walmart parking lot in New Philadelphia on July 25 by Hall County, Georgia Sheriff’s investigators, working with Tuscarawas County Sheriff’s investigators.
What the six charges are about
Counts 1 and 2 accuse Agustin-Ailon of a continuous rape of a minor (an unclassified crime) from May 29 to July 25, during which he engaged in sexual acts with the victim, who was younger than 13 years old. These counts also accuse him of intentionally coercing the victim. If convicted, both counts carry a sentence of life imprisonment with probation after serving 25 years.
Count 3 alleges that from May 29 to July 25, Agustin-Ailon repeatedly committed gross sexual abuse (a third-degree felony) involving sexual contact with the minor victim. If convicted, he faces a maximum sentence of five years in prison.
Counts 4 and 5 allege that on June 26 and July 1, Agustin-Ailon distributed sexually oriented material featuring a minor (a second-degree felony); that Agustin-Ailon created material depicting minors engaging in or engaging in sexual conduct. If convicted, each count carries a maximum sentence of eight to 12 years in prison.
Count 6 alleges that from May 29 through July 25, Agustin-Ailon engaged in continuous conduct of custodial violation (a felony of the fifth degree) by luring, removing, retaining, and/or harboring the victim as a child from her parents or guardian while removing her from the State of Georgia. If convicted, she faces a maximum sentence of 12 months in prison.
Agustin-Ailon is being held in the Tuscarawas County Jail and is scheduled to be arraigned at noon on August 16 before Judge Michael Ernest of the Court of Common Pleas.
